    any Loss they suffer or incur because you breach these Terms of Use or act negligently or fraudulently in relation to the Client Investment Information service.

      You will be notified when a new disclosure is available and how to access it. You may opt out of receiving this information and documents electronically by contacting us and this can be arranged for you.

      If you do not accept these terms and conditions and do not register for the secure website transaction advices and statements will be printed and mailed to you.

      Information and electronic transaction cut-off times

  23. You acknowledge and agree that any instructions that you provide StatePlus, or any information you seek, via the website are subject to the relevant cut-off times, as referred to in your fund’s PDS (www.stateplus.com.au/pds).
  24. You acknowledge and agree that:
    • StatePlus’ processing of electronic instructions for non-Fixed Fund investments are subject to a 3.00pm Sydney time cut-off;
    • if StatePlus receives completed electronic instructions for non-Fixed Fund investments after 3.00pm Sydney time on a business day, StatePlus will process your instructions using the unit price applicable to the following business day; and
    • amounts that are withdrawn from your fund may not be credited to your bank, credit union or building society account until at least two business days after the processing of your withdrawal from a fund.
  25. You acknowledge and agree that:
    • StatePlus’ processing of instructions for Fixed Fund investments are subject to a midnight Sydney time cut-off on the 14th day of the month; and
    • if StatePlus receives completed instructions for Fixed Fund investments after midnight Sydney time on the 14th day of the month, StatePlus will process your instructions using the following month.

  30. You agree to take precautions to keep your username and your password used to access the Client Investment Information service confidential and secure. In particular, you must not give your username or password to any person(s) for any reason or record or store your username with your password in such a way that it can be obtained by any other person (for example, storing your username and password on or near your personal computer).
  31. You acknowledge and agree that where you are a joint investor in an Investment Fund account, which requires both parties to sign instructions in relation to that account, that StatePlus will consider any instructions initiated via the Client Investment Information service to have been authorised by both parties.
  32. You agree that StatePlus takes no responsibility for unauthorised access to your account using your username and password.
  33. You acknowledge that you should also periodically change your password as a further precaution.
  34. You agree to immediately inform StatePlus on becoming aware, or having reasonable grounds to suspect that your username or password has been misused, lost or stolen or anyone else has accessed your information via the Client Investment Information service or any other breach of security has occurred.
  35. You acknowledge and agree that StatePlus may send confirmation or communicate with you via the website to the extent that the confirmation or communication relates to any instructions that you provide StatePlus via the website.
  36. You acknowledge and accept the risk that any communication to and from the website may be intercepted, used or modified by third parties despite reasonable security measures put in place by StatePlus.

    Termination

  37. StatePlus may cancel your access to the Client Investment Information service at any time without notice to you if StatePlus believes that continued use of this service may cause a loss to you or to us. You may cancel your access to the Client Investment Information service at any time by telephoning us.

    Liability of the parties

  38. You agree to indemnify and hold harmless each of the Provider Parties from and against:

  50. Transactions: Conditions of Use

    Before StatePlus can give effect to your instructions to rollover or transfer (‘Transaction’) any of your benefits into or out of a fund that you may transmit via this website you must agree to the following Conditions of Use (‘Conditions’).

    Confidentiality and security

  51. It is your responsibility to maintain the confidentiality and security of your identifier number (‘Identifier’), including but not limited to the Security measures contained in the Terms of Use.

    Transaction instructions

  52. You agree that a Transaction can only be validly made after:
    • you have properly conveyed your consent using the Identifier; and
    • the Identifier has been verified against StatePlus’ records.
  53. StatePlus does not have default arrangements for any of our products. If your application form does not specify the Fund(s) for investment, we will contact you to obtain your investment allocation.  If we are unable to contact you we may not be able to accept your application.

    Liability of parties for losses arising from Transactions

  54. In the event that you suffer loss as a result of any breach of the Conditions, negligence, fraud or dishonesty by us, StatePlus will indemnify you for the value of any direct loss to your relevant fund account balance.
  55. In the event that StatePlus suffers loss as a result of any breach of the Conditions, negligence, fraud or dishonesty by you, you will indemnify StatePlus for the value of any direct loss.
  56. You shall not be liable for any losses arising from:
    • the fraudulent or negligent conduct of StatePlus’ employees or agents in relation to a Transaction;
    • StatePlus’ system or equipment malfunctioning, including non-completion of Transactions and unreasonable delays in carrying out your valid Instructions;
    • any unauthorised Transaction where you have not contributed to such a loss; and
    • any unauthorised Transaction occurring after you have notified StatePlus that the security of your Identifier has been breached.
  57. StatePlus will not be liable to you in respect of any loss or damage suffered or incurred by you as a result of any breach of the Conditions, negligence, fraud or dishonesty by you.
  58. Except in the case of your fraudulent conduct in relation to a Transaction, the maximum value of your liability to StatePlus for loss will not exceed the total amount of your benefits in:
    • the fund that has the largest account balance, if the Transaction involves a rollover or transfer between two of more funds that StatePlus acts as trustee of; or otherwise
    • the fund that StatePlus acts as trustee of, if only one of the funds involved in the Transaction is a fund that StatePlus acts as trustee of.
  59. In the event that StatePlus suffers loss as a result of fraud committed by you, you will indemnify StatePlus for the value of any direct loss.
  60. For the avoidance of doubt, if the liability provisions contained in these Conditions are inconsistent with the liability provisions contained under the Terms of Use, the liability provisions contained in these Conditions will prevail to the extent of any inconsistency, where loss arises due to a Transaction.
  61. If StatePlus alters any of the Conditions after giving them to you (including implementing a default arrangement for the first time, or changing an existing default arrangement) StatePlus will notify you as soon as is practicable.

I acknowledge and agree to the Terms of Use and Transactions: Conditions of Use
